Full Journal pdf2000-04-19 Senate Journal Page 3303 HB 218 Senator Ward requested that the reconsideration on CS FOR HOUSE BILL NO. 218(FIN) An Act relating to property loaned to or held by museums be taken up. The bill was before the Senate on reconsideration. Senator Ward moved that the bill be returned to second reading for the purpose of a specific amendment, that being Amendment No. 1. Without objection, the bill was returned to second reading. Senator Ward offered Amendment No. 1 : 2000-04-19 Senate Journal Page 3304 HB 218 Page 4, line 3: Delete "After" Insert "(a) In addition to any other right of reclamation the person may have under 25 U.S.C 3001 - 3013 (Native American Graves Protection and Repatriation Act), after" Page 4, lines 5 and 6: Delete "the lender or owner of the property has two years to bring an action in court against the museum to claim the property." Insert "an interested person has two years from the later of the following events to bring an action in court against the museum to claim the property: (1) when the person learns that the museum has acquired title to the property; and (2) when the person learns that the person is the owner, lender, or heir of the owner or lender of property to which the museum has acquired title. (b)" Page 4, following line 9: Insert a new subsection to read: "(c) In this section, "interested person" means the owner of the property, the lender of the property, or, if the owner or lender has died, an heir of the owner or lender of the property." Senator Ward moved for the adoption of Amendment No. 1. Objections were heard. Senator Mackie moved and asked unanimous consent that CS FOR HOUSE BILL NO. 218(FIN) be held in second reading on reconsideration, with Amendment No. 1 pending, to the April 20 calendar. Without objection, it was so ordered.
